Lasting Powers of Attorney

The regime for appointing attorneys to act on your behalf in relation to your property and affairs changed on 1st October 2007.  It is no longer possible to put in place an Enduring Power of Attorney (although all previous powers are still valid) as these have been replaced by Lasting Powers of Attorney.

A Lasting Power of Attorney is a more complicated document and advice will need to be sought prior to appointing an attorney.  It is now possible to have two types of Lasting Power of Attorney

  • Lasting Power of Attorney – Property and Affairs
  • Lasting Power of Attorney – Personal Welfare

The Personal Welfare Power of Attorney enables someone to authorise another to make decisions regarding their care or personal welfare when they are no longer capable of making those decisions.  This was not possible in English Law prior to 1st October 2007.

It is also a requirement under the new law that before a Lasting Power of Attorney can be used it must be registered at the Office of the Public Guardian.  We can assist with this.
